Expungements
Expungement is a legal process by which an arrest, conviction, or diversion can be removed from one’s public record for most purposes. Convictions still count for purposes of criminal history in the event of further violations of the law. You should consult with an attorney to determine the specifics of your situation. There is currently a $195.00 filing fee (amount subject to change), payable to the Clerk of the District Court, which is fixed by the Kansas Legislature and Supreme Court Rule. Depending on the seriousness of the crime, convictions or diversions can be expunged three or five years after the case is satisfied. Some serious crimes can never be expunged. Juvenile adjudications can be expunged two years after the case is satisfied. An arrest which did not result in the filing of charges can be expunged once the District Attorney has declined prosecution.
